Argus West SIU SPEAR Lien Program Secures Favorable WCAB Decision After Challenging Chiropractic Corporate Registration

A three-part lien trial presented significant challenges involving a Chiropractic Corporation and related interpreter services. Argus West identified that, although the chiropractor was individually licensed, his corporation had not been properly registered with the California Board of Chiropractic Examiners as required under CCR § 367.5.

 

Argus West developed the defense around the corporate registration requirement and Business and Professions Code § 143, establishing that the corporation could not recover over $28,000 for services provided while it lacked the required registration. The WCJ ultimately found that the corporation did not hold the appropriate license and/or registration during the relevant dates of service and was barred from recovering reimbursement. The decision further found that the subsequent correction of the corporate licensing deficiency did not cure the defect retroactively.

 

The defense continued when the interpreting company pursued almost $3,000 payment for services connected to the chiropractic treatment. The WCJ specifically addressed the corporate registration issue, citing the requirements of CCR §367.5 and Business and Professions Code §143, as well as Argus West’s investigation and testimony concerning the provider’s licensing status.

 

Ultimately, the WCJ found that the underlying medical services were provided in violation of state law and that the interpreter lien claimant was not entitled to recovery. The interpreting company was ordered to take nothing by way of its lien.

 

In addition, a third lien claimant with a filed lien for $12,000 was resolved at 100% savings.

 

This decision highlights the value of a thorough SIU investigation and the importance of looking beyond the face of a medical lien. By identifying corporate registration and licensing issues that directly affected entitlement to reimbursement, Argus West helped establish defenses that ultimately resulted in a favorable WCAB decision and saving our client over $42,000 in liens.
